More than 40hrs/week

If someone works 6 days straight which adds up to over 40 hours but they work an 80 hour pay period, do they get overtime for those extra hours over 40?

Does it matter if happens during a transition between new days off and/or removal from the AWS schedule (44 one week/36 another week)? As I understand, that schedule is illegal now as overtime is necessary for working over 40 hours. Which brings me back to my original question.

Hi and thanks for your question. I put your question out for comment and got three good responses that all carry a common theme -- you are indeed entitled to OT.

1. "It doesn't matter if it was an 80-hour (pay period) or not, if they worked more than 40 hours in a calendar week, it's OT. It doesn't matter why."

2. "Overtime work means all hours of work in excess of 8 hours in a day or 40 hours in a week which are officially ordered in advance. Here is the OPM site this is from OPM - Alternative Work Schedules/Flexible Work Schedules

"My guess would be yes anything over 40 in a week is overtime according to OPM. I am sure this is contradicted in some other regulation. Why not ask for the OT, when told no grieve it using this as support and see if you get the OT. I have won OT grievances locally even when I was not correct, I just did a good enough job convincing them I was right."

3. "The way it's been interpreted here is anything over 40 hours between midnight Sunday through 11:59 pm on Saturday. The FAA's adminstrative workweek is Sunday-Saturday."

Thanks for that. So to make sure I got this right. If someone worked wed-mon and more than 40hrs. There should be some OT paid? I think that's what everyone is saying.

Yes. More than 40 hours in a week = OT.
