Dear Colleagues:
Since being named Acting Administrator, I've made it a priority to keep you up to date on developments that affect the agency.
As you know, we've been working for well over a year on the reauthorization of the FAA and the financing for the Airport and Airway Trust Fund (AATF). Congress has passed a bill in the House, but it has yet to make it through the Senate. In the interim, Congress has passed temporary extensions to make sure the FAA can pay salaries and keep the system moving.
Presently, our authority to spend from the AATF will expire on March 1. This fund pays the salaries of our Airports, F&E and RE&D employees. The rest of the agency's employees are paid from our Operations account.
The latest temporary extension also affects Aviation Excise Taxes, ending our authority to collect them after February 29. These are the taxes that fund the AATF. Unless Congress amends this legislation before the end of February, we'll be unable to sustain FAA operations beyond a few months.
Lastly, our contract authority for the Airport Improvement Program grants expired December 31. As such, we can't make any new grants. The airport sponsors who depend on these grants generally look to February 1 as the unofficial date on which they determine construction schedules. Needless to say, this puts them in an untenable situation as well.
From where I stand, it's premature to use words like "furlough," but you need to be aware that it may be necessary for us to issue official letters of notification saying that as of March 1, we no longer have the authority to pay Airports, F&E and Research employees.
Even with that prospect, I want to emphasize that we've been working with the Legislative Branch since December to make sure these ramifications are completely understood. I remain committed to working with Congress to resolve these issues in the next few weeks. I will keep you advised as further developments come along.
