After a bit of research I found something pretty funny regarding this tax issue. In 1998 a CPA named Martin Kapp wrote an article titled "Tax Advice For Controllers" and had it published The Air Traffic Controller . He advised controllers and a few other professions that the deduction for meals was legal. Someone in 2002 sent the article to the IRS asking for clarification and heres the response the IRS gave: http://www.irs.gov/pub/irs-wd/02-0020.pdf . I don't really understand what the IRS' position is from this .pdf so I tried looking for Mr. Kapp and his article on the internet. Lo and behold at the top of http://www.mkappcpa.com/ is a quote:

"A federal Court found that Martin Kapp incorrectly advised his clients to take an illegal tax deduction. This illegal deduction related to Mr. Kapp's position that mariners could claim a deduction for meals that were provided to them without cost. The link below sets forth the terms of the injunction that prevents Mr. Kapp from promoting this illegal deduction in the future."

nice find . . . to me, the wording in Pub 17 is CRYSTAL CLEAR - there should be no misinterpretation, its pretty simple - unless you're TDY somewhere and not receiving per diem, you can't legally take this deduction.
