It is not the place you live but the duty station you work at. I have spoken with the IRS on more than one occassion and on more than one day to different agents. The answer has been very consistent, Its not a loophole....its tax fraud. Designed and intended for those on a TDY and traveling away from their respective duty station. Gcheeze is on the money when saying ....just because people do it and get away with it does NOT make it legal. In fact there is a worksheet you have to answer to see if you qualify and one cannot get past question #2 or #3 unless you lieto yourself and ignore the intent. Ignorance is not justification. Well that clears it up. Thx for the replies. I am not one to fraud. I have many people who work with me who also live in ga but do not pay state tax (TN doesnt have any). Claiming they sleep at the tower or something. To me it's not worth the risk.
