Specifically, the DOT Final Rule contains a new provision for EXPANDED DIRECT OBSERVATION URINE SAMPLE COLLECTIONS for all employees subject to "return to duty or follow up drug testing." This means that employees who have had drug testing problems in the past and have successfully completed rehabilitation and/or other requirements and are subject to return to duty or follow up testing under, for example, a rehabilitation agreement, must provide all future urine samples under "direct observation."

Oh good so thats not me then. I was wondering what I was going to do. I have problems with shaking when I'm being watched. I would have pissed all over their hands while they hold it.

That has always been the policy in the military. They don't hold it for you, they're just there to make sure you are really providing a clean sample.

If you fall into this category, come into work with both hands wrapped in gauze. Ask the observer to undo your fly and let johnson out. Should be interesting!

Dont forget to have him/her wipe it off and resecure johnson when finished.

Ridiculous.

very interesting, they always looked at our junk in the military but I was under the impression that civilians have rights!

We had a guy, now retired.....told the tester that because of his obesity he would have to hold the cup. Tester sent him back to work without a sample...nothing more was ever said. Since retiring he has lost over 100lbs. the job wasn't good for his health.
